Fishinity Pro hereby grants you access to the application ("the App") and invites you to use the services offered through the platform.
To help explain things clearly, the following terms are defined throughout this End-User License Agreement.
Cookie: Small amount of data generated by a website and stored by your web browser.
Company: Refers to Fishinity Pro Ltd, responsible for this EULA and the services provided.
Country: England.
Service: Services provided by Fishinity Pro through its platform.
Third-Party Service: External advertisers, sponsors, marketing partners, and service providers.
App/Application: The Fishinity Pro software application.
You: Any individual or entity authorized to use the Services.
This End-User License Agreement ("Agreement") is a legally binding agreement between you and Fishinity Pro Ltd. It governs your use of the Fishinity Pro application and related services.
By downloading, installing, accessing, or using the application, you acknowledge that you have read, understood, and agreed to be legally bound by the terms of this Agreement.
If you do not agree with these terms, do not download, install, access, or use the application.
The application is licensed, not sold, to you by Fishinity Pro and may only be used in accordance with this Agreement.
Subject to the terms of this Agreement, Fishinity Pro grants you a limited, non-exclusive, perpetual, revocable, and non-transferable license to use the application.
This license allows you to:
• Download, install, and use the software on one computing device per purchased license.
• Access and use content available through the application.
• Install and use the trial version of the software for fifteen (15) days.
• Receive updates and new features during the one-year period following license purchase.
You agree not to:
• License, sell, rent, lease, distribute, or commercially exploit the application.
• Modify, reverse engineer, decompile, decrypt, or create derivative works from the application.
• Remove or alter copyright, trademark, or proprietary notices.
All intellectual property rights related to the software, including copyrights, trademarks, patents, trade secrets, logos, and proprietary materials, remain the exclusive property of Fishinity Pro and its licensors.
Nothing in this Agreement grants ownership rights to the software or any associated intellectual property.
You retain ownership of any work products you create using the software.
Any feedback, comments, ideas, improvements, or suggestions submitted to Fishinity Pro regarding the application become the sole property of Fishinity Pro and may be used without compensation or attribution.
Fishinity Pro reserves the right to modify, suspend, or discontinue the application or any connected services at any time without notice or liability.
Fishinity Pro may provide updates, upgrades, bug fixes, patches, enhancements, or other improvements to the application.
All updates shall be considered part of the application and remain subject to the terms of this Agreement.
The application may contain links to third-party services, websites, or content.
Fishinity Pro is not responsible for the accuracy, legality, availability, quality, or reliability of any third-party services.
This Agreement remains effective until terminated by either you or Fishinity Pro.
Fishinity Pro may suspend or terminate this Agreement at any time, with or without notice, if you violate any provision of this Agreement.
Upon termination, you must immediately stop using the application and delete all copies from your devices.
You agree to indemnify, defend, and hold harmless Fishinity Pro, its officers, directors, employees, affiliates, and agents from any claims, liabilities, damages, losses, or expenses arising from:
• Your use of the software.
• Your violation of this Agreement.
• Violations of applicable laws or regulations.
• Any agreements or relationships with third parties.
The application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.
Fishinity Pro does not guarantee uninterrupted operation, compatibility, reliability, accuracy, or error-free performance of the application.
To the maximum extent permitted by law, Fishinity Pro shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the application.
Any liability shall be limited to the amount paid by you for the application, if any.
If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
Failure by either party to enforce any right or provision under this Agreement shall not constitute a waiver of future enforcement of that right or provision.
Fishinity Pro reserves the right to modify or replace this Agreement at any time.
Continued use of the application after changes become effective constitutes acceptance of the revised terms.
This Agreement shall be governed and interpreted in accordance with the laws of England, without regard to conflict of law principles.
We may update this Agreement from time to time. By continuing to access or use the application, you agree to be bound by the most recent version.
If you do not agree with updated terms, you may discontinue use of the application and provide written notice of withdrawal where applicable.
Nothing in this Agreement creates an employment, partnership, joint venture, or agency relationship between you and Fishinity Pro.
You acknowledge that any breach of this Agreement may cause irreparable harm to Fishinity Pro, entitling the Company to seek injunctive or equitable relief in addition to other legal remedies.
Section headings are included for convenience only and do not affect the interpretation of this Agreement.
The application is primarily intended for users located in England. Users accessing the application from other jurisdictions are responsible for compliance with local laws.
Any claim or cause of action arising from this Agreement or the application must be filed within one (1) year after the claim arises; otherwise, it is permanently barred.
This Agreement constitutes the entire understanding between you and Fishinity Pro regarding the use of the application and supersedes all prior agreements and communications.
Additional terms may apply when purchasing or using other Fishinity Pro services.
